Tour One; 11269 Arbitrator Chin rescinded a 14-Day Suspension where an employee was charged with hitting an employee with a piece of equipment because he worked unsafely. The arbitrator stated that management failed to meet their burden of proof that the employee worked unsafely and that management contributed to a co-worker being injury due to congestion in the Linear Sorter area.
07483/07337 and 08045; Arbitrator Fritsch sustained the Service’s case concerning an employees indefinite suspension but rescinded the Services emergency placement. The employee was issued an emergency placement for off duty misconduct and months afterwards changed the action to an indefinite suspension. The arbitrator contended that the emergency placement was inappropriate but sustained the Services position that the indefinite suspension under those specific circumstances was proper.
