Grievance Update March 2019

18556 All Tours; in this issue the Union argued that line management changed past practices regarding excusing holiday personal from working, for example, the practices has always been that after the Holiday List is posted and the Service had required holiday employees to work their designated holiday, any volunteers after the posting will excuse the senior required employee from working his or her holiday. However, management changed the practice and volunteers after the posting did not excuse the required employee from working; issue resolved where it is agreed that under Past Practices that after a Holiday Schedule is posted, and there are additional personal who volunteered to work, management will excuse, if any the required employee following the pecking order on a one for one basis.

18558 Tour three; in this issue the Service argued that no employee can have annual leave in the month of December; issue resolved where the request for annual leave shall not be unreasonably denied and shall be considered on a case by case basis.

18555 All Tours; in this issue line management changed employee break and lunch schedules without consultation with the Branch President; issue resolved management will be reminded that if there are any changes in breaks and/or lunches it shall be discussed with the Branch President.

18546 Tour one; supervisor performed mail handler work; issue resolved where applicable employee shall receive a lump sum of $20.

18532 Tour one; in this issue the Union argued that local management failed to abide by past practices when assigning employees to higher level details; issue resolved the Service will comply with past practices as awarded by several arbitrators and followed the following practice such as; 1; canvass the immediate work area for available employees, and 2; use the tour seniority list to obtain an eligible employee to perform the higher level detail.

18515 Tour one; supervisor performed mail handler work; issue resolved where applicable employee shall receive a lump sum of $20.

18477 All Tours; Mid Islandís vehicle guide will be updated to reflect that the ride-on Fork Lift can operate outside the dock areas.

18520 Tour two; in this issue the Service was unwilling to post an open vacation week; issue resolved the week of 12.25 to 1.1.2019 should had been posted and management will refrain from such actions.

18484 Tour three; in this issue the Service denied a MHA an open week from 10.20 to 10.26.2018 claiming needs of the service; issue resolved the supervisor should not had denied the employee that week and there is no reason to state needs of service.

18565 Tour one; Grievant received a letter of warning for AWOL dated 11.30.2018; issue resolved the disciplinary notice shall expire within six months.

18533 Tour one; supervisor performed mail handler work; issue resolved where applicable employee shall receive a lump sum of $20.

18649 Tour one; supervisor performed mail handler work; issue resolved where applicable employee shall receive a lump sum of $30.

18644 Tour one; supervisor performed mail handler work; issue resolved where applicable employee shall receive a lump sum of $40.

18647 Tour one; clerk performed mail handler work; issue resolved where applicable employee shall receive a lump sum of $15.

19013 Tour one; supervisor performed mail handler work; issue resolved where applicable employee shall receive a lump sum of $25.

18626, 18627, 18625, 18623, 18622 and 18629 Tour one; in these cases the Service permitted mail handler assistants to work or fall into an Overtime status thereby bypassing employees on the OTDL; issue resolved applicable mail handlers on the before tour OTDL shall be compensated accordingly at the overtime rate of pay.
